Non-Studio Membership Agreement
This document outlines the terms of the Non-Studio Membership Agreement between the Fulton Street Collective (FSC), and the you as a member. This membership is on a month-to-month basis with a minimum of 3 months and may be cancelled any time after 3 months with 30 days’ notice. The parties hereby agree to the following terms and conditions:
Membership Fee: $ 25 per month, billed monthly on the date of registration, to the credit card used at registration.
Payments – Membership fees will be paid via Stripe authorization, with the credit card entered during online registration. Payments will be automatically charged as a monthly subscription until cancelled by the member. No account information will be shared with any other party outside of FSC and their agents. Billing information, invoice history and cancellation info is available on your account page.
Privacy & Consent – Member gives FSC explicit consent to use their contact information for the purpose of communicating information related to FSC-related news, events, or programming. FSC will do everything reasonably possible to protect the privacy of member information and will not share it with any 3rd party without the explicit consent of the member. FSC will never sell the members’ personal information to anyone.
Cancellation Process – Member may cancel membership anytime after 1 month, upon 30 days notification.
Notification – Notification of cancellation of memberships made online must be made on your account page, or by sending an email 30 days in advance to membership@fultonstreetcollective.com.
Member shall not assign, transfer or sublease any interest in the FSC Non-Studio Membership.
Benefits of Non-Studio Membership – Benefits include but may not be limited to the following:
- Priority waitlist for Studio Membership which includes private studios
- Participation in all FSC Membership events
- Artist Profile on the FSC Website
- Participation in select FSC public events, including the right to display and sell your work
- Free admission to all FSC public events, including Jazz Record Art Collective events
- Free admission to figure drawing events at Platform Studios
- Other benefits as designated by FSC management
Rules when On-Premise:
- The building and FSC entrances for all FSC facilities must never be left open
- No weapons or hazardous materials can be brought in
- No smoking of any kind is allowed in FSC facilities
- Solvents and other work by-products must be disposed of properly, never in the facility sinks
- Member is responsible for removing all personal property, trash, and other items directly from any space they use, to the dumpster outside.
- Member is responsible for restoring the space to the same or better condition as at the start of their visit.
Member will be liable for any physical damages, legal actions, and/or loss of reputation or business opportunities that FSC may incur as a consequence of the actions of Member or any of Member guests.
Member will protect, indemnify and hold harmless FSC from any and all legal actions which may arise from member’s use of FSC facilities, and against any and all liabilities, obligations, claims, damages, penalties, causes of actions, costs and expenses (including without limitation reasonable attorney’s fees and expenses) imposed upon or incurred by or against FSC by reason of any bodily injury to or personal injury to or death of any person or more than one person or for damage to property occurring on or about the Premises, no matter how caused. Member shall notify its insurance carrier of the waiver of the recovery in favor of FSC contained in this agreement.
Member must comply with all applicable license, certification, or other legal requirements, as required by federal or local governments or agencies, while exercising any of their benefits.
Any disputes arising under this contract shall be adjudicated in FSC’s local jurisdiction. In case of dispute, controversy or claim relating to this agreement the Parties agree, within 60 days of written notice by either FSC or Member, to amicably settle any differences by using alternative dispute resolution [ADR] methods, including the assistance of an independent mediator selected by both parties through the American Arbitration Association or any other sources of reliable professionals in this matter.
Termination – Membership Agreement may be terminated by FSC at their sole discretion, for any reason, with no notification period, if or when it deems necessary to protect their interests or the safety or rights of any member.
